Trust and Estate Litigation Advisory

SL&A’s Trust and Estate Litigation Advisory Group (TELAG) provides valuation, forensic accounting and financial investigations to counsel for disputes involving wills, trusts, family office operations, bankruptcy estates, assignments for the benefits of creditors and agricultural trusts.  Litigation matters arise from violations of the California Probate Code, the Uniform Probate Code, the National Fiduciary Accounting Standards Project, the Uniform Prudent Investor Act, the Uniform Principal and Income Act, the Uniform Fraudulent Conveyance Act, the Uniform Fraudulent Transfers Act, other state fraudulent transfer laws, the U.S. Bankruptcy Code including 11 USC §548 and §550, the Employee Retirement Income Security Act of 1974 (“ERISA”), the Perishable Agricultural Commodities Act (“PACA”), the Dodd-Frank Act (§203), the Investment Advisors Act of 1940 and the U.S. Internal Revenue Code.*

  • Served as plaintiffs’ accounting and auditing experts in an audit malpractice case involving the embezzlement of substantial fu
    nds from a group of related party beneficial trusts administered by a family office.
  • Functioned as plaintiff’s accounting and auditing experts in an accounting malpractice case involving the embezzlement of substantial funds from an agricultural trust.
  • Supported special counsel for the sponsor of a defined contribution retirement plan subject to a Department of Labor investigation of an alleged improper real estate investment, including the final monetization of the investment.
  • Assisted counsel for the trust department of a major bank in litigation involving improper administration of trust assets.
  • Administered the liquidation of a substantial real estate portfolio of a Chapter 7 bankruptcy estate.
